Hello,

Currently, I am living in the UK and working. My Husband is living in India and filed an RCR against me as I don't intend to go back to him or don't want to continue the marriage. The court wants me to show up on next month. What could happen if I don't show up? I am scared that if I go, he might win and the court can stop me from coming back to the UK. Is that possible? Can I also file a divorce case while this RCR is ongoing?

Please let me know. Thank you very much.

Your appearance should not be a problem since you can appear through a counsel. RCR is no way a hurdle for a Divorce case.

You just need to have a fair lawyer in your side to ensure all possible positive steps to get you a mutually consented Divorce. You may share your details at given mail ID in case you require any legal help.

Hi Sandhu,

Your query is clearly suggesting that you are not interested to continue this marriage anyway, more seemingly for your career in UK.. Otherwise no adversary factors of your present marriage. That apart you are interested for a Divorce and you can file a Divorce Petition while RCR is even filed.

In such a situation, it is better that both of you gracefully walk out of this marriage with a "mutually consented divorce" . That way both of you will not only handed over with a Divorce Decree within a month or so, but also both of you will be saved from unnecessary litigation cost, harassment & time loss.

It is not wise for you to force him to go for RCR or any other litigation which will invite troubles for you too. So think well to act well.

Thank you for your help. However, the problem is he already filed the RCR and the court wants me to be present there next month. In case, I don't go from here, can the court contact the embassy and force me to go back? or in case I go there to be present, can the court force me to stay in India and not allow to come back? MCD is not an option as he doesn't want a divorce.



I am in a very bad situation. Please help.
